Accused New York Subway Pusher Found Fit for Trial

A Queens, N.Y. woman accused of pushing an Indian man to his death in front of a subway train because she believed he was Muslim has been found fit to stand trial.

Erika Menendez, 31, was charged with murder in the death of 46-year-old Sunando Sen, who was shoved onto an oncoming subway train at the 40th Street-Lowery Street station in Sunnyside According to court documents, Menendez earlier told police that she did it because she hates Muslims and thought he observed that faith. Sen was Hindu.
According to the New York Daily News, a judge announced at a hearing on Jan. 14 that Menendez had been found fit for trial.

She did not appear in court, but an attorney hired by her family said she remains hospitalized. Menendez, who has a history of psychiatric problems, will be arraigned on an indictment Jan. 29.

“I pushed a Muslim off the train tracks because I hate Hindus and Muslims – ever since 2001 when they put down the twin towers, I’ve been beating them up,” police quoted Menendez as saying.

Sen, 46, died beneath the Queens-bound subway just six months after he opened his own printing business – New Amsterdam Copies – near Columbia University in Manhattan. According to The Daily News, Sen’s body was pinned under the second car after it came to a stop. News reports describe Sen as being unmarried and since both his parents had died, he lived with two roommates in a small apartment in Elmhurst. Sen, who reportedly lived in the city for the past 20 years, was cremated at a funeral home in Rego Park on Dec. 30 by his friends.
